These general terms and conditions govern the contractual relationship between ADD.venture-survival GmbH ("AdventureHealth") and its clients. They are supplemented by the individual confirmation issued for each programme, which sets out the trip-specific terms and prevails in the event of conflict. For expeditions that combine travel services for an inclusive price, the Swiss Federal Act on Package Travel applies in addition.
1. Scope
These terms apply to all programmes and services offered by ADD.venture-survival GmbH: guided expeditions, Davos Eisbad® cold-water sessions, corporate programmes and keynotes, and expedition-preparation programmes. By registering for a programme, the client accepts these terms.
2. Conclusion of contract; registration and selection
A booking or application constitutes an offer to enter into a contract. A contract is formed only upon written confirmation by AdventureHealth. For expeditions and preparation programmes, participation is subject to screening and selection, including medical clearance where required. AdventureHealth may decline an application without stating reasons.
3. Our role: organiser and local partners
Depending on the programme, AdventureHealth either provides the services itself or works with selected local partners and organisations it trusts. The individual confirmation states which services are delivered by AdventureHealth and which by partners. Where AdventureHealth acts as the organiser of a package, it is responsible for the proper performance of the package as set out in these terms and under Swiss package-travel law.
4. Prices and payment
Prices for cold-water sessions are stated per session and may be amended. Prices for expeditions and corporate programmes are quoted individually. Payment terms, deposits and instalments are set out in the individual confirmation. Prices are stated in Swiss francs and include statutory value-added tax where applicable, unless stated otherwise.
Indicative and binding prices. Prices quoted before booking are indicative. For expeditions, the binding price is fixed in the booking confirmation once the trip's costs, including the required expedition insurance and any permits, have been secured. The price stated in the confirmation is binding from the conclusion of the contract and may be revised thereafter only as set out below.
Price revision. After the contract is concluded, a price may be increased only where the confirmation expressly provides for this and states how the new price is calculated, only up to three weeks before departure at the latest, and only on account of an increase in transport or fuel costs, an increase in fees or taxes for certain services, or a change in the exchange rates applicable to the trip. An increase of more than ten per cent entitles the client to withdraw from the contract and receive a full refund.
Family and partner rate. Where a reduced family rate is offered for private or group cold-water sessions, it applies to the booking person together with: (a) relatives and in-laws in the direct line (for example parents, children, grandparents, grandchildren); (b) relatives and in-laws up to the fourth degree of the collateral line (for example siblings, aunts and uncles, nieces and nephews, cousins); (c) spouses and registered partners; and (d) a partner with whom the booking person lives in a stable, lasting partnership (a shared household). These categories follow the relationships recognised under Swiss law.
Other groups and the absence of a friends rate. Groups outside the family and partner circle above, such as groups of friends or colleagues, are welcome to book a private or group session at the standard rate. Unless a separate reduced rate (for example a friends rate) is expressly stated on the relevant product or booking page, no such rate applies and the standard rate is charged.
5. Changes and cancellation
Cancellation by the client. The client may cancel a booking. Cancellation fees, and where applicable forfeiture of the deposit, apply according to the schedule set out in the individual confirmation. These fees increase as the start date approaches and reflect the costs typically incurred and the income that can typically be recovered by reselling the place; they are set at a reasonable level.
Late arrival and no-show. Where a session has been booked, late arrival shortens the available session time, and non-attendance without timely cancellation in accordance with the confirmation may be charged as a no-show. Any specific timings apply as stated in the confirmation or on the booking page.
Changes and cancellation by AdventureHealth. AdventureHealth may make minor changes to a programme. Where a minimum number of participants stated in the confirmation is not reached, or where a significant change to an essential term becomes necessary, the client may either accept an alternative programme of equivalent or higher value (or of lower value against a refund of the difference) or withdraw from the contract and receive a prompt refund of all amounts paid, without prejudice to any claim for damages. AdventureHealth may also change or cancel a programme for reasons of safety, weather or operational necessity.
6. Participation, eligibility and risk
Expeditions and cold-water activities carry inherent risks. The client confirms that they meet the stated eligibility and medical requirements, that the information provided is accurate, and that they will follow the safety instructions of the guides. Participation may be made conditional on compliance with these requirements.
For reasons of safety, AdventureHealth may decline participation, or exclude a participant from an activity without refund, where the participant does not meet the stated requirements or does not follow the safety instructions of the guides.
7. Passports, visas, health and entry requirements
For expeditions abroad, the client is responsible for holding valid travel documents and any required visas, and for meeting the health and entry requirements of the destination, including any vaccinations. AdventureHealth provides general guidance only and is not liable for the consequences of missing or invalid documents or of refused entry.
8. Insurance
Adequate personal insurance is the responsibility of the client. For expeditions, this includes cancellation cover and search-and-rescue and repatriation cover. Proof of adequate insurance may be a condition of participation.
9. Image and media rights
AdventureHealth produces photographic and video material in the course of its programmes. The use of material in which a participant is identifiable for marketing purposes is governed by separate consent. A participant may decline or withdraw such consent. 10. Liability
AdventureHealth provides its services with professional care. Where it organises a package, it is liable for the proper performance of the package under Swiss package-travel law. Otherwise, and to the extent permitted by law, liability is limited to intent and gross negligence, and AdventureHealth is not liable for risks inherent in expeditions and cold-water activities that materialise despite the exercise of due care. Mandatory statutory liability, including liability for injury to life and limb, remains unaffected.
11. Force majeure
AdventureHealth is not liable for the non-performance or delayed performance of its obligations where this results from circumstances beyond its reasonable control, including adverse weather, natural hazards, official measures or transport disruption.
12. Complaints
If a service is not provided as agreed, the client must report this without delay, during the programme, so that AdventureHealth has the opportunity to remedy it. Complaints after the end of the programme must be made in writing within the period stated in the confirmation. The client may also contact AdventureHealth at any time at info@adventurehealth.ch.
13. Financial protection and assistance
For package expeditions, AdventureHealth secures the amounts paid by the client and the client's return journey against the event of its insolvency, as required by Swiss package-travel law. AdventureHealth also provides appropriate assistance to a client who finds themselves in difficulty during a programme.
14. Data protection
Personal data are processed in accordance with the Privacy statement.
15. Use of artificial intelligence
Certain internal workflows make use of AI tools. Personal data provided by the client are not transmitted to those AI tools. Where any feature would transmit client input to an AI service, this is indicated before submission and the applicable retention period is shown. 16. Severability
Should any provision of these terms be or become invalid, the validity of the remaining provisions is not affected. The invalid provision is to be replaced by a valid provision that most closely reflects its intended economic purpose.
17. Governing law and jurisdiction
These terms are governed by Swiss law. The place of jurisdiction is Davos, Switzerland, subject to any mandatory consumer-protection venue. Enquiries may be addressed to info@adventurehealth.ch.
